Write to thank the Transportation Committee.   Write to urge the full senate to pass SB06-78 unanimously and send a clear message to Governor Owens.  This is just the first in many steps.  We need to stay vigilant and stay involved.


This bill is, in essence, a re-introduction of SB05-230 that passed overwhelmingly in the Senate and the House during the 2005 legislative session and was then vetoed by Governor Owens.  Because the legislature had adjourned for the year, there was no way to attempt an override of the veto.  This year we've got more time.

This bill removes the power of eminent domain from a private toll road company unless they enter into a public-private arrangement with a government entity like CDOT.
