SB05-230
Senate Bill 05-230, in its current form, would effectively remove the power of condemnation from a private toll road company. It was introduced to the Senate by Senator Tom Wiens (Republican, 4th District, El Paso and Douglas Counties) on Friday, 22 April 2005. It was then assigned to the Senate Transportation Committee. It was addressed in the Senate Transportation Committee on 26 April 2005. About three hundred residents showed up to support the bill. Senator Takis decided to not allow public testimony but asked for those in favor of the bill to stand up and then asked for those opposed to stand. It passed the Senate Transportation Committee by a vote of 6 to 1 (Senator Nancy Spence felt that the "standing vote" was not appropriate and wanted to study the opposition view by the Colorado Department of Transportation before a floor vote). Due to a procedural fight, SB05-230 went to the Judiciary Committee on 2 May and passed out of there without an amendment the FRTR and CDOT wanted to add to allow for a private toll road to have the power of condemnation under certain conditions. Early in the evening the full Senate heard the second reading and it passed by a wide margin. It passed its third reading unanimously on 3 May and is off to the House. It was introduced to the House on 3 May and assigned to the House Transportation Committee. On 4 May, it passed the House Transportation Committee 9 to 1 (1 absent). Very late on Thursday, 5 May, 230 passed its second reading in the House. It had its Third Reading Friday, 6 May, and passed 49 to 15 (1 absent). The final vote is below. It was signed by the President of the Senate on 25 May 2005. It was sent to Governor Owens on 27 May 2005. On 6 June 2005, Governor Owens vetoed the bill.
